Adoption leave and pay policy

Taking time off for adoption leave is still a relatively rare occurrence but it’s worth having a policy to let employees know their entitlements. In most cases, this will be by reference to the statutory rights.

Adoption leave

Our Adoption Leave and Pay Policy statement reflects the statutory provisions. If you wish to provide enhanced rights to either adoption leave or pay, you will need to adapt your policy statement accordingly. A failure to grant an eligible employee adoption leave or pay will give them the right to bring a claim against you in the employment tribunal. Be aware that if the child’s placement is terminated during the employee’s adoption leave, they will continue to be entitled to adoption leave and pay for up to eight weeks after the placement ends.
